Court orders Falun Gong to dismantle protest

VANCOUVER - The Falun Gong must remove the protest hut and billboards it has maintained outside Granville Street’s Chinese consulate for seven years, the B.C. Supreme Court has ruled.

“Even if they are held to constitute a form of expression, the method of expression is incompatible with the fundamental purpose of the city street...,” Justice Sunni Stromberg-Stein said in her 37-page ruling.

“I agree with the city that it is not necessary that structures obstruct either pedestrian or vehicular traffic, as any obstruction is illegal.”

The group’s lawyer said he’ll recommend an appeal.

“I think, with respect, the court was wrong, and I’m hopeful the higher court will see it that way,” said Joe Arvay.

Stromberg-Stein concluded the group breached a bylaw prohibiting structures that encroach on a city street. She granted the city an injunction that would require the group to take down the display within seven days.

Protesters erected a hut, banners and billboards in July 2001 protesting what the Falun Gong says is China’s consistent persecution and torture of members of the religious group.

Former mayor Sam Sullivan first ordered the structure dismantled in 2006, saying it was built without permission and encroaches on the city sidewalk.

The city raised concerns about liability and insurance, and claimed the respondents never sought permission.

Arvay said the case is “absolutely about the importance of the vigil as perhaps the most fundamental kind of expression we have as a society, which is political expression,” but Stromberg-Stein said it had more to do with street usage and public order than freedom of expression.

And you watch, soon they'll be flying military planes over the city to keep an eye on us. :yes:

Haha. Sorry Ravman, it is an unexpected surprise that you would take the city's side against the Falun Gong. At least it shows that people are indeed complex in their political leanings - no more branding of people with a large brush I guess.

I just find it funny how there is some apparent religious right }(in Canada) for their protest wall when they claim (while in china as a point of defense) that they are not a religion but merely a physical exercise movement and thus shouldn't be persecuted. Hmmm.....

The court action doesn't restrict their right to protest in any way. It simply requires them to remove the structures that were built on city property.

Unless I am not understanding this correctly.

Anyway, part of me is sad that the Falun Gong won't be able to embarrass the Chinese government on a permanent basis. Those assholes need to learn a thing or two about human rights.

they are annoying to me.... when i am driving my jaguar or benz (and always when i am driving those 2) down granville from kingedward towards bway in the far lane the only 1 car parked is the Falun Gong car.... due to limited visibility due to the hill .... it is very very annoying when you are going down and suddenly you have to slow down and change lanes

The court action doesn't restrict their right to protest in any way. It simply requires them to remove the structures that were built on city property.

Unless I am not understanding this correctly.

Anyway, part of me is sad that the Falun Gong won't be able to embarrass the Chinese government on a permanent basis. Those assholes need to learn a thing or two about human rights.

They are being asked to remove all structures/signs which have been nothing but temporary over the last 7 years. Protests are certainly allowed.

You can NOT drive a Jaguar or a Benz, let alone both, and be an NDP Supporter. I think that'd make you the biggest hypocrite of their supporters, and that is saying something. :haha:

like seriously... can i not live in the British Properties in West Van have properties in Whistler, Kelowna and Bowen Island, Can i not have a Benz, Jag and BMW and vote for CAROLE JAMES AND THE BC NDP??????

BECAUSE that is what i plan to do on in may....

but not vote for Carole directly :tup:

Well, "rich people" usually are best at thinking they know what is best for "poor people", which may attract them to the NDP.

But "rich people" are generally not in favor of socialism, it doesn't bode well.
