As I understand it, in new construction in NYC now, they have to do that if they build right up to the property line. They're anticipating that a new building as tall or taller may be built on the neighboring lot, so it would be shortsighted of the developer to place windows where they may be covered up in 5 years. I've also seen this a ton in a lot of the new buildings in LIC as well, and you may see this being an awkward issue when they attempt to build up to the property line next to prewar buildings, and windows have to be permanently obscured.
