PURPOSE OF THE APPLICATION:
To modify the redevelopment plan approved under Site Specific By-law 1201-2009 for the construction of a
mixed-use building containing residential and commercial uses, by: adjusting the height of the tower and
podium; altering the parking supply; and reducing the depth of the main floor retail space, along the St. Nicholas
frontage.
REQUESTED VARIANCE(S) TO THE ZONING BY-LAW:
1. Section 4(e), Site Specific By-law 1201-2009
Portions of the proposed building will exceed the heights as indicated on Map 2.
2. Section 8(3) Part XI 2(ii), By-law 438-86
The minimum required main floor depth is 7.5 m.
The main floor retail space will range in depth, as follows: 5.3 m, 6.0 m and 7.4 m.
3. Section 4(5)(b), By-law 438-86
The minimum required number of parking spaces to be provided is 294 (264 tenant spaces and 30
visitor spaces).
In this case, 200 parking spaces will be provided (190 tenant spaces and 10 visitor spaces).
