You are correct. In isolation, crossing the border is illegal.
However, I will reiterate that according to international law, including notably the Universal Declaration of Human Rights of 1948, people have a
right to claim asylum in another country. In Canada, that means that people crossing the border
for the purposes of claiming asylum will not be charged.
Similarly, going above the speed limit is illegal. Doing so in an ambulance is not.
