That doesn't even make a little sense. There is no height limit there, the developer is seeking special permits for the bulk at ground level, and combining the development rights obtained from the landmark buildings. Furthermore, the Bank of America tower is 1,200 ft - a fact pointed out by the NIMBYs themselves.
