the league got it right as well. there was intent in the hit and that's where the 5 game suspension comes from, the bruins play on that fine line between aggressive and overly aggressive, all it takes for some emotion to fuel a players style of play and get what we saw on Sat.
It's no different then Burrows getting emotional during the Stanley Cup and biting the Bruin player, he's was an agitator and the biting results from a player doing something stupid but within his style of play. Marchand is a dirty skilled player where as Burrows is an irritating skilled player.

The very same referee, Dan O'Rourke, was involved in the Raymond / Marchand incident in the Stanley Cup Finals (presumably more emotional than Game 40 of the regular season) and didn't see it fit to call a penalty nor did the league feel supplemental discipline was necessary, and Shanahan's only response was "that was last year, not this year". So, WRT to the repeat offender notion, it'd be a lot easier to be one if they just randomly decided things that never were before, are now suspension worthy. This video does show the point of contact in both incidents were above the knees, so *technically* clean by league rules that actually exist.

It's very easy to assume the NHL considers a lot more than the play, now, when it comes to suspensions. Like injuries (no matter how they happen), and fan backlash.
But anyways, it clearly doesn't matter anymore.
I'm going to run with my other conspiracy theory that the league only suspends top Bruins players when their next game or 2 is against the Habs. What is this, the third time now
