Do they really have to fight to get their deposits back?? I'd guess some might be interested in TNS or 300 Main

The fight is likely to get the deposits back now instead of sometime in the future when certain official criteria have been met with respect to the death of the project.

They put down 10% deposits on $200k plus suites. So yes I'd fight for my deposit too.

TDS says the money is safe. If you can't trust them then who can you trust?
Why the money hasn't been returned is beyond me.

Because it is likely that the contract doesn't expire until the "delivery of the building" which is supposed to happen next fall.

What they are doing is taking them to court and claiming that because their is no chance the building can be constructed by the delivery date, they should get their money back earlier than the contract specifies.

You're confusing people who invested in the financing of the project, with those who put down deposits for purchasing actual units. The deposits have been held in trust with a lawyer and are fine and untouched. The investments in the financing (see syndicated mortgages) is what is likely gone.

Now CV can sell this to a legitimate developer to build something modest but useful. Maybe TN can build a nice 20ish story mixed use apartment.
