exit2lef hit the nail on the head, I'm also of the opinion Matt is simply protecting his interest. It also will get tight with two years of construction affecting his business and ability to make use of his patio but if he can make it through that, the benefit will be overall good for him.

They are going full gas on the construction site today, already digging for the foundation.

As for me, I have never been to Angel's and now I never will. Any business owner that can't see the economic impact of adding residents right next door is a very dumb businessman! When these developments are completed, there will not be a better location where he could make money! If he prefers Westgate, let him go and bring in a real owner that will care care about the communuity.

It's a crying shame 1 man is trying to ruin all of this development for his own selfish interests. Besides, what could the chances be that Derby could purchase Angel's lot down the road for a potential 2nd development?

Everyone who complains about the slow pace of projects in Phoenix should watch what's going on at the Derby site. All this week I've seen noticeable progress from one day to another. Nothing like the threat of a lawsuit to motivate people, I guess.

Yeah a Cinderblock rectangle and surface lot is going to be a major underutilization of that parcel in the coming years.

This will get dismissed. To confirm, work is continuing? If so, that is great news. What a jerk that guy is. He's hoping to sell his land in the future to someone who is going to build something just like the Derby. I hope someone files a lawsuit against his hypocritical ass.

Update: drove by the Derby today around 11a, and all equipment has been removed from the lot - no staff or workers either.

Oh man. I noticed yesterday when I drove by in the morning that there were no workers and the equipment was not moving

Notice the picture above your post showing a graded site. Digging began at the site early last week but they filled it back up by the time that picture was taken.

This development has been in the works since Nov 2015 and this idiot has the power to halt construction the day after it begins? What a joke of a system.

He's not the only one in the neighborhood fighting this building, actually most of the business owners are.

It's not just because of the construction time or the mess it will cause while it's going up, it's partially because they all state the developer has refused for the past year to discuss their concerns or behave like a neighbor who is interested in the well-being of those surrounding them. They feel as though the developer is being given the power to ram something down their throats and be rewarded when they're done.
