Excavation Begins At 5Pointz, 22-44 Jackson Avenue

Topping out at 41 and 47 stories, the planned buildings will contain just over a million square feet of floorspace. The beige stone-clad high rises will include 1,115 apartments, according to permits, and 20% of the units will rent at below-market rates. Affordable units will be split between the two towers, and there won’t be separate entrances for market-rate and affordable apartments.

The first few floors will host 20 artist studios, galleries, 40,000 square feet of retail, and a public parking garage with 262 parking spots. They’ll also be flood proofed, which is an important consideration for a property within a few blocks of the East River and the heavily polluted Newtown Creek. The garage will be hidden away on Davis Street, fronted by galleries and a 40 by 80 foot “dedicated graffiti wall” planned as a concession to artists.

The site plan promises plenty of green space, including a large interior courtyard between the buildings and private park space with fountains at the back of the complex, along Sunnyside Yards.

HTO Architects designed the buildings, and David and Jerry Wolkoff of G&M Realty are the developers.

The wrecking ball finished off the site’s old warehouses, which were once occupied by the Neptune Meter Company, in late January. Then the Department of Buildings approved new building permits last month.

Graffiti artists suing 5Pointz owner for whitewashing their work from building

Nine graffiti artists who spray painted creations across the world-renowned 5Pointz building filed a lawsuit Friday in Brooklyn federal court, seeking unspecified damages from the owner who whitewashed away their artwork.

The plaintiffs — well-known taggers from New York, London and elsewhere — said developer Jerry Wolkoff broke the law by covering up the graffiti mecca without giving them time to retrieve their work.

The aerosol artists say they are owed substantial cash damages because Wolkoff painted over their al fresco works.

In 2013, members of the 5Pointz nonprofit sued to try and stop Wolkoff from tearing down the buildings to construct new development.

They lost that battle, but Brooklyn Federal Judge Frederic Block noted in his ruling that they could be owed damages if their graffiti works qualified for “recognized stature.”

Such works are protected under the U.S. Visual Artists Rights Acts.

The “ephemeral nature” of graffiti on a building exterior would come into play, Block said.

The judge said some of the works cited, including a famous piece from Lady Pink titled “Green Mother Earth,” might have qualified for protection.

The artists who sued Friday were not given any warning from Wolkoff that a whitewash was coming — and therefore had no time to pull down or preserve their artwork, their attorney said.

ome of the pieces could have gone to museums, had the artists been given notice, the suit said.

“Our clients seek justice for the unlawful destruction of their artwork. This case will demonstrate that these cherished works of art must be protected to the fullest extent of the law,” said attorney Eric Baum of Eisenberg & Baum, who filed the suit.

“This case is not only brought on behalf of plaintiffs, but it sends a message to everyone that the unlawful destruction of artwork will not be tolerated. If anyone violates federal law under the Visual Rights Act, they must be held accountable,” added Baum.

The creation of 5Pointz dates to 1993, when Wolkoff first let visual arts use the derelict Long Island City property he owned as their large-scale canvases.

By 2002, well known artist Jonathan Cohen was running 5Pointz as an artist installation — attracting tagging talent from around the globe.

The iconic buildings had more than 350 works of visual art on the walls — inside and out — when Wolkoff destroyed them, the lawsuit said.

The colorful, eye-catching creations were torn down for good last summer.

Now they're really embarassing themselves. The buildings were whitewashed by THE PROPERTY OWNER! What don't they get about that?

They sniff too much paint, so its difficult and it might take them a day or two to get it. Graffiti is a form of vandalism anyways and what the owner does with his or her property is up to ultimately the owner. Glad this eyesore is out.

I used to write a bit back in the day. The art vs. vandalism debate could go on ad infinitum. That aside, what I see here is a particularly gross display of entitlement and an apparent complete misunderstanding of how the real world works when it comes to ownership.

These new renderings remind me of Citypoint in Brooklyn. I hope they turn out way better than the renderings.

'5Pointz' Developers Who Razed Art Mecca Can Use Name for High Rise: State

The graffiti was there legally. The artists had all the permissions to paint and were paying money to rent the studio space, and the graffiti was curated, so not everyone could just show up to paint. 5Pointz was a world famous graffiti site, hands down the most important/famous graffiti area in the world. NYC lost a cultural attraction that people from all over the world came to see for a bland architecturally-bankrupt apartment block.
