Exactly. This is the right route to go... go with a carrot early on, but don't let developers walk all over you - have a whip available, and be willing to use it.

Essentially, escalating penalties (or fees) for missing milestones. A couple missed milestones to be expected on a large project, so no penalty/fee for 1 or 2 within certain parameters. Miss more, penalties/fees escalate exponentially.

Unfortunately for the City, doubt they could find a legal way to implement now & have bylaw(s) apply to Capital Pointe... they'd get grandfathered.

Permit renewed will expire in 6 months unless developer shows meaningful construction.

Unless they expropriate, right? I'm not sure if they want to take that route though. The compensation the city would have to pay Fortress would be significant.

The dream lives on, the city of Regina has issued a new construction permit on Capital Point.

They cannot expropriate unless they need the land for municipal reasons such as infrastructure. Why would they want to anyway?

Say in a perfect world fortress decided they did want to build the foundation. How soon would they need to start to get a decent amount of foundation done in 6 months ? Could it all be completed in that time frame ?

But what does it really matter if the permit expires in 6 months if no meaningful construction occurs? They can then just apply for and be issued another new permit if that happens.

Fortress does this everywhere, they stall and stall on project after project -- it looks to be part of their business model, which it seems, has a very little to do with actual development, and a lot more to do with securing investor funding and relaying the perception that development is occurring to those investors.

Fortress is a joke. I don't understand how they would ever be granted a permit in the first place given their reputation. I have a hard time taking any of their proposals seriously. The city of Regina should probably just move on.

Never said it was a good idea. Just saying it's an option if things get out of hand between this builder & city council and legal action is threatened against the city. More of a last resort than a first option, especially if public safety becomes a concern.

The city is legally obligated to issue the permit. Blame the province for pushing their antiquated legislation.

Any time in the next 10 years that you wonder what is going on, just assume that they are waiting on a fake permit and that they are just about to start construction, and that they will be finished in the next 18 months.

I predict that there will be a few inches of water in the pit come Spring, and because of it, they will write off the entire 2018 construction season.
