Exactly. This is the right route to go... go with a carrot early on, but don't let developers walk all over you - have a whip available, and be willing to use it.
Essentially, escalating penalties (or fees) for missing milestones. A couple missed milestones to be expected on a large project, so no penalty/fee for 1 or 2 within certain parameters. Miss more, penalties/fees escalate exponentially.
Unfortunately for the City, doubt they could find a legal way to implement now & have bylaw(s) apply to Capital Pointe... they'd get grandfathered.
