1494 Commissioners Road West - 4s (Appealed)

Interesting zoning application to allow for this low rise 10 unit apartment building. Current zoning is SFH.


Just east of Chestnut Hill



A Zoning By-law Amendment to allow for:
  • A 4-storey apartment building with a maximum height of 13.5 metres and 10 dwelling units.
  • Special Provisions requested to permit a minimum rear yard setback of 0.3 metres, east Interior side yard depth of 0.3 metres, west interior side yard depth of 1.5 metres, lot coverage of 46.2%, and a height of 13.5 metres.

A 10 unit 4 floor building won't look much (if any) bigger than the houses it will be beside lol.

Especially considering the part of the building closest to the SFH's steps down to 3 storeys. There is a similar building on Riverside as you approach Byron that was built in the last few years, and that one is right beside some 1-2 storey townhomes.

City planning staff is recommending that Council approve the zoning changes for this. Will be discussed at tomorrow's planning committee meeting.

And yes, there is quite a bit of opposition to this - 43 letters and a petition with 36 signatures. I agree with the previous comments that this proposal is not dramatically different than what has been on this property for a long time.

Not surprised at the loud neighbors but honestly this will make very little impact to their lives and is a much better use of that property.

This stretch of Commissioners will see a lot more of these types of proposals, similar to the ones across from Byron Northview.

Also saw the 2 properties sold at 1428 / 1420 I am sure we are going to see another 4/5 story building.

Planning committee voted 3-1 to refuse this development due to its proximity to an environmentally significant area (Warbler Woods) and a lack of buffer. Goes to full council on March 5th.

Fuck, really? Lol. OK to carve a street of 4000 sq ft houses out of those woods, but god forbid a 10 unit building goes behind 1 single of those houses. I don't even think the house on the corner would fit on this lot lol.

Look forward to see the debate at full council. No matter which way it goes it will be appealed to OLT by the loser most likely which means a 2 year delay before any detailed site plan application followed by a building permit.

"At issue for [some councillors] was the setback from the boundary of the Warbler Woods environmentally sensitive area. New city environmental management guidelines introduced in 2021 mandate there be a 30-metre setback between any development and an environmentally sensitive area.

The first rezoning application for the property was received by the city in 2012, and any applications prior to the new rules are being grandfathered in, said city staff, who backed the project."

Council voted 8-7 to refuse this development.

Will be interesting to see if the developer will appeal Council's decision, or bring back a new application with a larger setback from the ESA.

The developer has appealed Council's decision to the Ontario Land Tribunal.

My guess is that the OLT will side with the developer on this one, since planning staff from the City had recommend Council to approve this.
