Hello everyone, this is the first New West thread that I saw, so I thought someone can give me some info. I'm from Winnipeg and consider the Vancouver area my second home as I'm there often to visit relatives and friends. I was there just this weekend and stayed at my aunt and uncle's place just south of the 22nd street station at the end of the Queensborough bridge. They told me that the city is looking to expropriate their property to make way for a development consisting of three high rises. Does anyone have any info on this?

Look for the mayor's graduate thesis. IIRC, he did it on Transit Oriented Development at that skytrain station. That should be a good indicator. His name is Jonathan Cote.

Now that is a progressive mayor. No wonder New Westminster is looking up these days.

They're not looking to expropriate anything. I suspect that your aunt and uncle have been misinformed by someone in the neighbourhood that doesn't want towers.

What the city wants to do is to change the land use designation in the area to allow for the possible redevelopment of properties there to include up to three towers, some low-rise buildings, and some townhouses in the area directly surrounding 22nd Street SkyTrain station. The area is all currently single family homes, and it's been identified as a future Frequent Transit Development Area.

They're still working on it, but it will definitely not include expropriation.

An important question that I realize I cannot answer is whether there is precedent in Canada for a government using eminent domain to expropriate private property that is then made available in some fashion to a 3rd party in order to facilitate a land assembly and commercial development à la Kelo v. City of New London in the US. Would anyone here have any insight on this?

Eminent domain is a U.S. term and doesn't mean anything in Canada.

The Canadian term is expropriation, in BC under the Expropriation Act.

As a historical note, the blocks on which Pacific Centre were built were expropriated and made available to the Fairview Corporation for the development of Pacific Centre under the Tom Campbell administration - very controversial at the time.

It's referenced here (Section 6) in this piece of legislation authorizing the subsequent ground lease to Fairview Corporation.

Pac Centre has leasehold tenure? Huh... that might clarify my curiosity about why Easy Park runs the parking underneath. The city might have retained the parking operation for its own objectives? It would be interesting to know how long the remaining lease term is.

Yes, the City owns (maybe leases (?) the underground parking at Pacific Centre.
