Why not? Although that is exactly how the original 1991 Gulf War started (slant drilling).

Well, with the way things are going in the world, that water might soon be worth far more than oil or potash

“SkyCity condo buyers suing to get deposits back

Proposed class action alleges builder in breach of contract because of delays on Winnipeg project”

Quote:
Condo buyers are suing SkyCity Centre Winnipeg, claiming it has become "patently obvious" the company has breached the sale agreement because it can no longer meet the move-in date of October 2019, say court documents filed Monday.

Do they really have to fight to get their deposits back?? I'd guess some might be interested in TNS or 300 Main

The fight is likely to get the deposits back now instead of sometime in the future when certain official criteria have been met with respect to the death of the project.

They put down 10% deposits on $200k plus suites. So yes I'd fight for my deposit too.

I believe one member said the deposit was long gone, so sounds like a legit fight.

Found it

You know where your money has gone?

Firsst, 1/3 GONE on day one. Poof. Comissions, and Advances on Profits (Fortress is a fraud)
Second, you know all of those fancy news conferences, investor meetings, etc. Guess who paid it? You. Think Jawad Rathore flew economy class to Winnipeg? Nope.
The sales centre? Yup, you paid for it
The architecture, engineering, and legal documents for all of the various JV's? You paid.

There will be no money left. I am sorry that you were part of the Fortress Fraud. It really is sad that they scammed to many mom and pop investors.

TDS says the money is safe. If you can't trust them then who can you trust?
Why the money hasn't been returned is beyond me.

Because it is likely that the contract doesn't expire until the "delivery of the building" which is supposed to happen next fall.

What they are doing is taking them to court and claiming that because their is no chance the building can be constructed by the delivery date, they should get their money back earlier than the contract specifies.

You're confusing people who invested in the financing of the project, with those who put down deposits for purchasing actual units. The deposits have been held in trust with a lawyer and are fine and untouched. The investments in the financing (see syndicated mortgages) is what is likely gone.

Now CV can sell this to a legitimate developer to build something modest but useful. Maybe TN can build a nice 20ish story mixed use apartment.
