It doesn't count as a spire by all known definitions. Only CTBUH recognizes it because they caved to 911 sentimentality and decided to ignore their own criteria for what counts as a spire; I.e., it has to be architectural. The garbage pointy thing is still lacking its architectural cladding (except for the very tip) and is therefore ineligible.

Sears Tower is still tallest in the US until CPT takes over.

Actually,around 781 ft. Was supposed to be at least 900ft but got a height cut, Goldman Sachs gave in to critics saying it would have been too large.

agreed, but keep in mind this tower rose in the immediate aftermath of 9/11 - so the subsequent period of fear would have given NIMBYs all the support they needed to shorten it even if construction had commenced on a taller version. I'm pretty sure the height cut happened beforehand, but I can't remember.
