Miami wins appeal in Grove Bay, SkyRise lawsuits

The Third District Court of Appeal gave the city of Miami two key victories Wednesday in siding with circuit court judges who tossed lawsuits challenging the SkyRise Miami tower and a major redevelopment project on the Coconut Grove waterfront.

Judges Frank Shepherd, Richard Suarez and Thomas Logue said the plaintiffs in the two cases, former Monty’s Raw Bar owner Stephen Kneapler, and Miami Commission candidate Grace Solares, lacked the standing to sue. Both argued that alleged violations of the city charter gave them standing, but the court sided with the city’s attorneys, who said allowing Kneapler and Solares to sue would essentially allow anyone to take government to court over any decision they didn’t like.

Attorneys for the two plaintiffs said Wednesday that they were disappointed and were examining the judges’ opinions in order to weigh their options going forward. For city officials, the hope now is that Grove Bay Investment Group, the developer behind a redevelopment of the seven-acre parcel north of Miami City Hall, will take control of the site and begin construction after almost 20 months of delays.

J.C. Planas, a private attorney representing the city on the Grove Bay and SkyRise lawsuits, said he also believes the ruling applies to a legal challenge of the SkyRise referendum by auto magnate Norman Braman and Miami-Dade mayoral candidate Raquel Regalado. Planas said he’s filing for re-hearing on the city’s request to dismiss the suit for lack of standing.

They've been doing preliminary work on the site. But very minor. Its a start at least. I'd like to see this get past the hurdles and quickly rise. Been too long.

Fall should see foundation work. The work currently is just adding a pier and utilities. Very minor though. With the lawsuit gone, this looks good to go. I say getting past the hurdles because this project has a record of just crap coming at it. Hopefully no new anti-urban fabrication will rise up and challenge this. Opponents of this do everything to stop it, yet they will most likely be shopping there and visiting it, and loving it.

SkyRise Miami is not similar to the Eiffel Tower, Sydney Opera House or Golden Gate Bridge icons that it has been promoted with.

They are hoping it succeeds in terms of tourism. Its catchy marketing material, and may be good enough to lure 1st timers. Observation decks are money makers.

Miami ranks up there in terms of international visitors to the U.S.. A key demographic they are seeking.

Beach mayor to county: Spend on Venetian bridge, not SkyRise

The Venetian closure on Monday eliminated a secondary route to South Beach, promising short-term complications when it comes to visiting the county’s most popular tourism destination. In his letter, Levine cited Basel, a popular December art show and one of the biggest weeks of the year for hotels.

The Venetian’s closure on Monday followed a push by Levine for Miami-Dade to spend the $4.7 million that the contractor says would allow the work to be finished within six months. That would speed up the project 33 percent and increase the cost by closer to 40 percent, according to estimates in letters released this week.

I saw the parachute jump idea there doing inside the supports of the tower, but that seems a bit dangerous don't you think? I mean whats going to stop that wire from hitting the building?

No! and here is why:

Developer Jeff Berkowitz said SkyRise Miami will be a vertical adventure park with observation decks, nightclubs, a flight simulator ride and a bungee jump-like platform.

The $430 million tower looks like a capital “R” as it slopes back toward the area of the Hard Rock Cafe.


The developer is looking for "foreign " investors to build this hideous thing and he will probably never get enough investors.

this guy is a nut job:

Berkowitz Development Group estimates 3.2 million visitors a year to SkyRise Miami, which would make it the largest attraction in South Florida and fifth largest in Florida.
The targeted opening for SkyRise is late 2017.

Miami needs towers like this. although Miami has a nice skyline, there is nothing that really stands out. adding some iconic buildings will really take the skyline to the next level.

Don't forget 1000 Museum. Probably the most radical project in the U.S. and a work of art. Sunny Isles also has some winners going up. World Center will be starting up in Q3 with a beautiful Marriott and centerpiece tower. Hopefully One Bayfront rises in the future.

SkyRise Developer Aiming To Take Title Of City’s Tallest

The developers of the polarizing project submitted plans to the FAA earlier this month requesting an increased height of 1,045 feet above ground. In 2008, the agency had approved a height of 990 feet above ground.

The 2008 application listed a site elevation of 10 feet above sea level, putting the top of the tower at 1,000 feet above sea level. The new filing lists the site elevation at 4 feet above sea level, which would put the peak at 1,049 feet above sea level.

If approved, SkyRise would beat out several other proposed towers by just a few feet in structure height, although others would match sea level height. Swire Properties’ One Brickell City Centre was recently approved at 1,040 feet above ground, or 1,049 feet above sea level. Near SkyRise, developer PMG has a pending application for a 1,041-foot condo tower at the Empire World Towers site, which would also reach 1,049 feet above sea level.

All of the projects are taking advantage newly eased height limits in the downtown area, allowing for 1,049-foot towers.

Florida Supreme Court rules in favor of SkyRise Miami

Solares’ suit was filed shortly before voters residing in the city approved SkyRise Miami during the August 2014 primary election.

The complaint alleged that Miami officials violated the city charter by entering into a new long term lease with General Growth Properties — the owners of Bayside Marketplace where SkyRise Miami will be located — without seeking competitive bids.

In May, the Third District Court of Appeals ruled Solares lacked the standing to sue the city and that citizens can’t use the courts to enforce local charters unless they can demonstrate they have a personal stake in the matter.

Linda Carroll, the attorney representing Solares, told The Real Deal that the Supreme Court’s denial is a major setback for citizens who want to protect public waterfront land from private development.
